Too Stoned To Drive? What You Need To Know About Cannabis DUI’s in Washington (and Oregon)
Please note that while every effort has been made to provide accurate information, no part of this article constitutes legal advice.
The question “Am I too stoned to drive?” is a tricky one to answer objectively. While there are various rules of thumb and gadgets like keychain breathalyzers for alcohol, even lawmakers and police have trouble clearly defining impairment when it comes to weed. To complicate matters further, we live right on a state border here in Vancouver, and there are different rules in Washington and Oregon. That means that it’s technically possible to be good to drive on one side of the river, but not on the other.
While police can measure the concentration of THC in a blood sample, it’s really not that simple. Because THC is stored in fat, and because tolerances to weed vary widely, the amount of the chemical floating around in your blood is a poor indicator of how impaired you actually are (orwere). Research suggests that it’s impossible to set a threshold for cannabis impairment. But that hasn’t stopped lawmakers from doing so, at least here in Washington.
In the rest of this piece, we’re going to take a look at what the laws say, how they’re currently being enforced, and what to expect if you are pulled over while driving under the influence of cannabis. Finally, I’ll share the results of some field (couch) testing I did with an app called Druid that’s designed to measure impairment from cannabis and other drugs.
What Do The Laws Say?
In Washington, the initiative to legalize weed included a defined concentration, 5 nanograms of THC per milliliter of blood, that constitutes illegal impairment for driving. Police may also use specially trained drug recognition experts to establish evidence of intoxication.
Oregon, on the other hand, doesn’t have a quantitative limit to define impairment. Drug recognition experts are used instead in all cases. Police in Oregon may still collect blood, breath, or urine samples for evidence if there is suspicion of impairment. In both states, drivers give “implied consent” to be tested for intoxicants any time they are driving.
If someone is pulled over and the officer suspects cannabis impairment (just smelling like weed is enough), they will probably start with some questions about what was consumed and when. Based on the responses and behavior, they may then decide to administer field sobriety tests. If impairment is detected, a drug recognition expert will be called or the officer will obtain a warrant for blood testing. We’ll gloss over some details here about what else might happen during an arrest.
From there, court proceedings begin that are best navigated with the help of a qualified attorney. In Washington, if a blood test comes back over the 5 ng/ml limit, DUI charges will definitely be filed. But wait a minute, what about the whole issue of research that shows it’s impossible to set a legal threshold for cannabis impairment?
As it turns out, juries are much more friendly towards cannabis users who test over 5 ng/ml than they are towards alcohol users with blood alcohol over %.08. That’s good news for serious stoners everywhere, who may never drop below the legal THC limit in a given day no matter how sober they get. Check out this story from Colorado, where a driver in exactly that situation won their trial.
The question remains though, of how cannabis impairment can be reliably measured without the problems seen with blood testing or the subjectivity of human testers. One intriguing answer is to use a combination of software and sensors that in its simplest form just looks like a smartphone.
Getting Druided
Interest in developing apps for measuring impairment has been steadily growing among academics and even our National Institute on Drug Abuse, which recognizes that existing tests are unreliable and produce false positives. Druid is a first of its kind example of what such an app might look like. It was developed by Harvard researcher Dr. Michael Milburn and is available for iPhone, iPad, and Android devices.
In the name of science, I bought Druid for $0.99 and started putting it to the test. The app has three modes: Practice, Baseline, and Test. Practice is for getting to know the various little games Druid uses to measure your reactions, decision making, sense of time, and balance. Baseline is for gathering data about how you perform sober. Test, finally, is for testing with intoxicants. By comparing baseline and test results, Druid can give you an idea of how impaired you are, theoretically, at least.
After a couple practice rounds, I felt ready to get my baseline set. My first baseline was right around 45 (higher scores mean more impaired), which is classified as “Mild Impairment.” According to Druid’s website, it’s normal for initial baselines to be a bit high while first getting to know the app. Or maybe I’m just permanently on that level. The site also says that the data collected so far indicates that users with a blood alcohol content of %.08 typically score between 55-58.
Highly Scientific Test #1
Then I smoked some of that Grease Monkey by Ketura Cannabis. While this part of my test was not especially scientific, that’s kind of the whole point: it’s not really possible to just weight how much cannabis goes in your bowl and figure out how impaired you’ll get. Instead, I made sure I got stoned enough that I wouldn’t feel comfortable driving. Then I did a test with Druid and scored 48, “Moderate Impairment.” After cracking and drinking a ~6% IPA, my score was 47, back down to mild impairment (I felt fine to drive at this point). Smoked cannabis tends to peak quickly after consumption, so these results make sense to me. The next day, I did a baseline measurement and scored 44.
Highly Scientific Test #2
For a second test, I picked up some Alien Fruity Pebbles from [SKoRD]. This time, I scored a baseline of 41. After smoking to a sufficient level of impairment, I scored 48 again. Then I waited a bit, smoked again, and scored 48. Sometime later when I felt ok to drive, I scored 47. While there’s not a big difference between these results in either test, I was able to convince myself that Druid is a useful tool for measuring my impairment level.
This “research” was pretty casual, using different strains and mixing in alcohol, but then again, that’s how life goes. I’d encourage anyone who enjoys intoxicants and operates vehicles to check out Druid. Whether you’re stoned, drunk, or just sleep deprived, it can provide a relatively objective sense for whether you should think twice before getting behind the wheel.
The Verdict
Druid comes with a disclaimer: if you feel too impaired to drive, don’t drive, no matter what the app says. Personal judgment is still the best way to gauge your impairment level, though software tools may be the future standard for testing both at home and on the side of the road. In the meantime, many “chronic” cannabis users will be at constant risk of having to prove in court that they were in fact sober, just because they smell like weed.

4/20 & 7/10 Cannabis Holidays: What are they and why do we celebrate them?
Growing up we all knew about 4/20. It was that time of day that we all looked forward to. That time of day where you’d smoke em’ if you got em’. But where did it originate from? I was always told that it was the police code for “marijuana arrest in progress”. But that has long since been discredited. In California for instance, all the police codes relating to marijuana start with “113xxx”. So where did the origins of 420 begin?
According to power of the internet (wikipedia.org) the association with smoking marijuana and 420 began in the 1970s in Marin County, California. A group of high school students known as “The Waldos” would say “420” to each other at some point during the school day as code to meet for a smoke. The reasons for their meeting time, it turns out, aren’t very complicated: school ended around 3:00 p.m., and then came sports practice, and then it would be about 4:20. And the social circumstances that led to the ritual might be familiar to any number of high-schoolers. The legend goes that on Dec. 28, 1990, Deadheads in Oakland handed out flyers inviting people to smoke “420” on April 20 at 4:20 p.m — and one got in the hands of Steve Bloom, a former reporter for High Times magazine.
Shout out to owner of High End Papers, Brian Lee for providing some of the craziest rolled products that I have ever seen last 420. Follow him on Instagram: @blee213 & @highendpapers
If you’re not one of the hip kids (like me), you might not even know what the “other” cannabis holiday is. I was introduced to the term by a former coworker, who at 7:10 every day would say, “turn your phones upside down!” I did and my phone read 1:40. ¯\_(ツ)_/¯ He seemed to get unnaturally upset that not everyone used a digital clock on their phone. But if you do, it spells “oil”, referencing cannabis concentrates, which I covered in an earlier blog that you can read more about here. 710 is a fairly recent holiday, and has really only become popular in the past few years; most likely coinciding with the increasing popularity of legal concentrates.
However you like to celebrate, whether it be flower or concentrates, remember to smoke em’ if you got em’ this upcoming year for 4/20 and 7/10. And remember to stop by High End Market Place where we go all out every year with dank deals and special events every 4/20 and 7/10.

The H.E.M.P. Purchasing Team Shops for Cannabis
What does the H.E.M.P. Purchasing team look for while shopping the i502 market?
Recently, the High End Market Place purchasing team hit the road once again in search of some exotic cannabis strains to add to our cache of the highest quality flower. Along the way, we visited three recreational cannabis grow operations for the first time, bringing the total to 162 growers that we have visited on our hunt for the best cannabis products that Washington has to offer. We also stopped in at with our friends Xtracted to learn about which new flavors are coming and what we can expect coming from them in 2018. Needless to say, we are excited about the latest and greatest that the market has to offer. In other words, that “NEW new.”
High Standards
High End Market Place has a very specific buying process that requires us to be on the road consistently to visit and revisit cannabis grows. First we find a cannabis producer that provides a product that might fit our shelves. We then request samples. When they arrive, we closely examine each sample to make sure that the product reaches our very high standards.
Every product must fulfill 3 basic, yet fundamental requirements:
- Cannabis Appearance (It MUST be visibly appealing!) Is it frosty? Good plant structure? Quality packaging? Appropriate labeling? Does it look like the best product it could be? If it has “purple” in the name, does it actually have some purple in the flowers?
- Cannabis Flavor (It MUST taste good!) Does the flavor match the description? Does it taste how it’s supposed to taste? Does the flavor last throughout the burn process? Is it cured properly? Does it burn clean down to white ash? Does the edible taste “weedy” or “grassy”? Can you feel/taste the potency as you consume it? Can you taste the nutrients, sprays, or grow medium as the end user?
- Cannabis Smell (It MUST have the right funk!) Does the smell match the description? Does the smell remain all the way to the end consumer? Is the packaging helping or hurting the preservations of flavor and cure? Does it have the scent that we associate with the strain?
On this buying trip we found three producers that met all three of these requirements! That is a very rare thing, as we only choose to work with around 10% of the producers that we visit. This weed scouting trip was dedicated to filling the top shelf with a some new and exciting flavors and producers from Seattle and beyond.
The Stops
Our first stop was at Seattle medical marijuana legends, Fire Bros. This fabled cannabis producer’s entrance into the i502 recreational cannabis market has been long awaited by those who know fine cannabis. As originators of amazing phenotypes of strains such as Blueberry Pancakes, Ewok (Cannabis Cup Winner), Elmer’s Glue, God’s Gift and White Widow. While we were there they showed us some top secret “new new” coming out of their amazing pheno hunting adventures. We are sure that these new strains will please any cannabis connoisseur, especially because these flavors are unavailable anywhere else in the legal weed marketplace.
Our next stop was with at a processing facility in south Seattle. There are some very restrictive zoning laws in Washington that force cannabis businesses to cluster together. This building was an extreme example of that. In one building we counted two cannabis retail stores, and no fewer than three cannabis processors. The building isn’t that large, meaning that it’s probably one of the densest concentrations of cannabis businesses anywhere in the state and a great place to get introduced to new processors.
We went there to meet another group of Seattle medical legends, Nebula Gardens. We didn’t get to see their grow facility, but it was important for us to meet them and see how they process and handle their cannabis products. We were also able to get some samples of some amazing flowers and pre-rolls, and check out great looking oil collabs that they have done with Xtracted Labs.
We love what Nebula Gardens is doing, and we can’t wait to visit their farm to really see how these masters of ganja create the magic. You can look forward to high end cannabis products from this farm coming to HEMP in the near future, especially as they expand their production facilities to provide greater supply. Finally, we stopped in at a couple of the other processors in the building to get a peek at what they’re working on.
Last stop on our trip was to a like minded store, Clutch Cannabis, in Seattle. They were the lucky recipients of one of the first drops from the multiple cannabis cup winning breeder Exotic Genetics. We are on the hunt for some of those Exotic Genetics flavors, and we will let you folks know as soon as we lock something down!
YOUR PREFERRED MARIJUANA DISPENSARY
At HEMP we proudly serve both recreational and medical customers. In 2016, High End Market Place was the first cannabis dispensary to be licensed under the new WA State Department of Health medical marijuana program. Since then, we have registered thousands of patients, and have given them access to the highest quality, most ethically sourced cannabis products in the market. Our store is truly Vancouver’s one stop for the best Cannabis Dispensary.
